One step closer

No immunity from lawsuit for Morgan sheriff


Blogger Comments:  Folks, if our recall is correct Sheriff Ana Franklin found out down south in Alabama she did not have immunity when she hit an elderly couple and seriously injured them.  Check us if we are wrong on this.  How in the world can sheriffs be immune from wrongdoing?  Nothing to do with the whistleblower claim but just in general.  How can sheriffs in any state, not just Alabama be immune from following the laws they are sworn to uphold?

An official act according to USLEGAL:

Official act means “ any act done by the officer in his official capacity under color and by virtue of his office." Miles v. Wright, 22 Ariz. 73, 83 (Ariz. 1920)
Official Act means any act that is done in the official capacity or it can be some official duty. It is an act sanctioned or authorized by a public official or public agency. The term also applies to an organizational act which is authorized by the organization.

Lord.  How in the world could Ana's attorney in the Hall case believe that she was acting within her official capacity when she hit the Hall's in an almost head-on collision?  When she was not on duty?  That case settled.

This is an issue that most citizens should consider.  Can a sheriff commit horrible acts against citizens and then claim "official capacity" as a justification of their acts?  We believe that is exactly what Sheriff Ana Franklin feels and does.  

It is sad that there are those out there who believe that because they are law enforcement the rules do not apply to them.  The truth is most law enforcement officers are honest hard working people just like everybody else.  However, it only takes a few bad apples to spoil the entire barrel.

  1. Qualified immunity in itself is legal fiction created by the courts which has no legislative credibility. It has made it nearly impossible for citizens to hold law enforcement accountable for wrongdoing against them.

    We make mistakes, we gotta pay for it. Police make mistakes, they just say "I didn't know."

  2. Ana is still to full of herself to realize that the Whistleblowers and all those that have worked so hard to expose her have won and her so called immunity won’t protect her at all anymore. Her lies, deceit, blackmail, blackball, evil manipulative ways won’t help her anymore. Truth and a few very determined people went a long way to make our county a better place by exposing a small part of the corruption by this evil lunatic of the sheriff. It took a long time but truth and justice are coming and the ones responsible will be held accountable. Lawyers getting rich off Ana and Ana continues to empty the coffers of the Sheriffs Office all she can until she looses the ability to do so. She did not spend it all on Deputies as she left office. She is stealing it for her own greed leaving the Sheriffs Office as broke as possible while living the high life and using tax payer money for her legal defense.

  3. After Greg Bartlett lost the election in 2010, he used the money to purchase: 11 Tahoes for patrol, 8 Silverados, 4 civilian Tahoes, new fingerprinting system for the jail, new uniforms for the entire department, and who knows what else. Ana hasn't done that in her two complete terms.

  4. The AP picked up this story and it's being reprinted and broadcast all over the country. She's famous for all the wrong reasons. Shouldn't be able to show her face anywhere.

    1. Yes...but she will. If she has one person crying with her, it reinforces her denial even more. It's kind of sad to watch someone who is delusional put on a facade to look innocent. I guess being honest with herself is a hard pill to swallow.
