Sheriffs - Lawrence County/Morgan County whats the difference?

Blogger Comments:  Folks does it really matter if we are talking about Lawrence County, Morgan County, or some 49* other sheriffs in the state?  They do what the darn well want to do.  The taking of millions of dollars of inmate food funds over the years is despicable.  Makes you wonder what else they do.  Who if anybody has oversight of Alabama sheriffs?  It appears that sheriffs do not answer to a higher authority.

Our sources sent us a picture of Reserve Officer Melson who according to our sources has been a reserve deputy for the Lawrence County SO for at least 10 years.  His Lawrence County patrol car sits in the front yard of his house. He’s allowed to drive the patrol car home and answers calls. What’s the problem? Well, he’s never attended The APOS Training Academy. Melson has been working for Sheriff Mitchell for approximately 10 years. He has never been certified.  Reserve officer fall under strict criteria as seen below.   Melon must be special to the sheriff as our sources tell us no other reserve officers have a take-home SO patrol car.   Not Melson's fault of course;  we can rightfully blame his boss for allowing it.

Lawrence County we hear you loud and clear.  Reserve deputies in Morgan County have/had take-home patrol cars as do corrections officers and believe it or not so does the Chaplains. The only way sheriffs are going to be forced to follow ethics and Alabama Law is when the State Attorney General, the Ethics Committee, and Governor Ivey take charge and start prosecuting elected officials.

While we are on our soapbox we have problems with the Attorney for Ms. Ford who is accusing Judge Kavanaugh of sexual misconduct.  Not for the complaint but for making demands that none of us females across the nation could possibly demand.  We as women who accuse men of sexual harassment are required by law to face our attacker in court.  Are Ms. Ford and her attorney setting a precedent of demands that will not be afforded to all women across the nation. 

What is it about folks such as Ms. Ford and sheriff Ana Franklin that believe the everyday citizen's rules do not apply to them.  We understand that is isn't just women who have that mentality.  Dang!  We have 49 male sheriffs in the state that believe it is OK for them to take food funds because they believe the State Attorney General opinions do not apply to them.  Then we have Franklin who knew or should have known if she has an IQ of average intelligence that the food funds was off limits for her.

Let's just say that either Alabama citizens are electing sheriffs of less than average intelligence or the sheriffs know the difference between right and wrong and at least 49 of those sheriffs chose to take inmate food funds ignoring legal opinions.


Melson's ride 

2006 Alabama Code - Section 11-43-210 — Reserve law enforcement officers; appointment by city or town; qualifications; powers.
(a) The appointing authority of any city or town in the State of Alabama may appoint, with or without compensation, one or more reserve law enforcement officers to assist or aid full-time or part-time certified law enforcement officers as defined by this section. Reserve law enforcement officers appointed pursuant to this section shall serve at the pleasure of the municipal appointing authority.
(b) Any person desiring appointment as a reserve law enforcement officer after April 12, 1990 shall submit a written application to the municipal appointing authority certifying that the applicant is 19 years of age or older, of good moral character and reputation, and that he or she has never been convicted of a felony or of a misdemeanor involving force, violence or moral turpitude. The applicant must also consent in writing to a fingerprint and background search.
(c) For the purposes of this section, the term "certified law enforcement officer" shall mean a municipal police officer who has completed the training requirements of the Alabama Peace Officers' Standards and Training Commission as set out in Article 3, Chapter 21, Title 36. The functions of a reserve law enforcement officer appointed pursuant to this section shall be confined to the following:
(1) Patrol operation performed for the purpose of detection, prevention and suppression of crime or enforcement of the traffic or highway laws of the state, provided the reserve law enforcement officer acts at all times under the direct control and supervision of a certified law enforcement officer.
(2) Traffic direction and control may be performed without direct supervision, provided, however, that supervisory control is exercised by a certified law enforcement officer whose total span of control would be considered within reasonable limits.
(3) Reserve officers may render crowd control assistance at public gatherings or municipal functions as directed by the municipality provided supervisory control will be exercised by a certified law enforcement officer whose span of control would be considered within reasonable limits.
(d) No reserve law enforcement officer shall have authority to exercise any power of arrest unless he or she has completed the training requirements of the Alabama Peace Officers' Standards and Training Commission as set out in Article 3, Chapter 21, Title 36.
(e) No reserve law enforcement officer shall carry any firearm unless he or she has obtained a properly issued permit for such firearm and the appointing authority has approved his or her use of such firearm. Reserve law enforcement officers may use such firearms only to the extent permitted by properly promulgated regulations of the appointing authority.

  1. I don't have a problem with reserves, they can be a tremendous benefit. I do have a problem with providing a take home car, liability wise. As for what Mr. Melson is doing it is really simple, he and Sheriff Gene Mitchell are breaking the law.he has to be with a certified law enforcement officer at all times and under their supervision, anything else is a violation of the law. Gene claims to be holy'er than thow while being mr ethical but in reality he is just a law breaker. The blogs over the last few weeks shows gene mitchell being anything but Mr clean. He has just kept it quite over the last 12 years. Well it is time for people to know he is not perfect and he is not who he claims. So either he doesn't know the rules which is a problem or he is intentionally breaking the rules / law, which is it sheriff?

    1. One thing about it, melson is proud of that car. I mean you talking about making it your show piece. Parked it in his front door side ways so we can get the full view. To bad it all is against the law! But I don't fault melson I fault the sheriff, he should know better. I think it is time for someone to investigate the sheriff's department and not ABI.

  2. Am I the only one to notice gene mitchell doesn't fight his own battles. He always has someone else out front fighting his battles, while he sets behind the desk at HQ. Guess he can't get his hands dirty, guess that's why they call him "clean Gene" in Talladega co.

  3. Gene crying about signs does he realize how rediculas he looks, he has littered this county with his illegal signs on the right away. Just this morning I seen three signs with 25 feet of one another and two were within two feet of one another, why guess he thinks signs vote. He must think cemeterys vote, I know they use too. I seen a sign this morning at a cemetary, I guess gene realizes max is getting the best of him so it is time to go back to a tried and tested democratic party tradition of getting the winning votes from the cemtery. Gene has 4 signs including one at cemetary within 1.5 tenths of one mile on a 2 lane county rode, that is what you call desperate.

  4. Well cameras are out now let's see if we can get some pitures of genes crew tearing down Max signs. We know it want be gene because he has never put up or took down a sign in his life, he is to good for that he is a manager, he sits at HQ behind the desk nawing on that big cigar while his menions do the work. Maybe we will catch Carl again. Sheriff your getting beat, get more illegal signs out on the right of ways.

  5. With lawrence county being broke I think we need to look at what we provide such as take home cars also with 3/4 of the employees living out of county aND the cost involved Esp for fuel.

  6. Why is gene mitchell engaging in dirty montgomery politics by attacking max integrity when he is the one who can not tell the truth. Gene said often in 2006 that he would only serve one term if elected, he did we get from that at 66 years of age to today at 78 years of age seeking a fourth term. If mitchell is successful that would put him at 82 years old at the end of a fourth term. He said in an article in decatur daily he would not keep left over food money and based on what he told the decatur daily he has made about one million dollars over the past 12 years. He said he would not hire his brothers on campaign trail on 2006 and in an article in decatur, both brothers have been there for 12 years and to make it worse they are in the two highest paid positions in the sheriff's department chief deputy and captain. So I ask you why is gene attacking max, because the whistleblower is exposing his character and his lies to the people of lawrence county. Look at how much county and food money is going to someone with the last name mitchell. Remember LEVITICUS, give me $300,000 to fight crime. It's just money, money, money.

  7. Sheriff Gene Mitchell, what is the Status of the evidence room investigation being conducted by the ABI? Normally your investigations against employees are wrapped up within a month or less, this investigation has been going on for 9 months. Is it because the investigation is over and you found no wrong doing. That is what is being talked about within the department. So release the findings of the inv and get this out. It was a big deal 9 months ago but not today why? Of course with Gene no matter where the inv starts they all end up at the same place LETS, one of these days #1 may have to answer question about his LETS inquiries, he is clean either on this issue.

    2. This was nothing more than a political wack job to get rid of an employee, did not have anything then and he still doesn't have anything, if he had anything at all he would have charged the inv immediately. Release the results of the investigation Sheriff!

    3. Sheriff Mitchell, what was the difference in the investigator who was charged and immediately fired and the deputy charged with the exact same crime and placed on paid administrative leave? Two identical crimes handled completely different, why sheriff gene mitchell. Is this how your suppose to run a department? But this is just one example of a lot of issues that are handled this way situations are handled based on who the individual is and nor on the violations. Are you in the click or not decider how issues are handled. No clear rules and regulations in place, clean gene doesn't want anything written down.

  8. Who all is driving county owned vehicles home and how much fuel is being used and their mileage. I know the chief deputy use to drive his county back and forth to church south of cullman, twice on Sunday and once on wednesday, that's a lot of miles and fuel, not to count five trips back and forth all the way to the franklin county line. Waste, waste, waste.

  10. Take the high road gene says, this is from the man who's campaign headquarters is in the gutter, he is terrified he is fixing to get beat. Also become a facebook sparring match, well if it's done it will have to be done on fb, because when you come out of HQ you run to that county tahoe because you afraid you might get asked a question by a voter, only go to safe events and insulate your self from the average voter. Why don't you come out of hiding and this can be done face to face. So why don't gene and Max have an open to the public un timed debate. What do you say gene do you want to spar face to face with a career fighter? Figure not, you can't answer questions about your dept when you can get multiple follow ups that you can't silver tongue your way out of them. Also thanks for following the Morgan county whistleblower blog.hang in there you about to get to retire again.
